Welcome to ELARA Homes (“ELARA Homes”, “we”, “our”, or “us”).

These Terms of Use govern your access to and use of the ELARA Homes website, services, and any bookings made through our platform. By using our website or making a reservation, you agree to be bound by these Terms.

1. Website Use

You agree to use this website only for lawful purposes. You must not:

● Misuse the website or attempt unauthorised access
● Introduce malicious code, viruses, or harmful material
● Use the website for fraudulent or misleading purposes
● Copy, reproduce, or distribute content without permission

We reserve the right to restrict access if misuse is detected

2. Bookings & Reservations

All bookings are subject to:

● Availability of the property
● Confirmation by ELARA Homes
● Receipt of applicable payments

A booking is only confirmed once you receive written confirmation from us after we receive the entire payment.

We reserve the right to refuse or cancel bookings in case of:

● Incorrect pricing or system errors
● Fraud suspicion
● Breach of these Terms

3. Check-in & Check-out

Standard times are:

● Check-in: as communicated per property
● Check-out: as communicated per property

Early check-in or late check-out is subject to availability and may incur additional charges.

4. Guest Conduct & House Rules

Guests agree to:

● Respect property rules and community regulations
● Avoid excessive noise or nuisance behaviour
● Not host parties or events unless expressly permitted
● Ensure only registered guests stay at the property
● No photography is allowed
● Houserules as mentioned in the apartment and as per the bookings

Failure to comply may result in immediate termination of stay without refund.

5. Security Deposit & Damages

A security deposit may be required.

ELARA Homes reserves the right to deduct from the deposit for:

● Property damage
● Missing items
● Excess cleaning
● Rule violations

If damages exceed the deposit value, guests remain liable for full reimbursement.

6. Payments

All payments must be completed as per booking terms before the arrival at the property.

We use secure third-party payment providers.

Failure to complete payment may result in cancellation of booking.

7. Cancellation Policy

Cancellations are subject to the cancellation terms communicated at the time of booking or listed on the booking platform.

Elara homes reserves full right to hold/cancel the booking, incase full payment is not received from the guests.

All the bookings are strictly non-refundable unless otherwise stated.

No-shows or early departures are non-refundable unless otherwise stated.

8. Pricing & Errors

Prices may change without prior notice.

We are not responsible for typographical or system errors in pricing. In such cases, we reserve the right to correct the price or cancel the booking.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ELARA Homes shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of our services or stay at any property.

ELARA Homes’ responsibility is limited strictly to services and matters within the interior of the booked property under its direct management.

We shall not be held responsible for issues arising outside our control, including but not limited to:

● Building management decisions or actions
● Community or homeowner association (HOA) rules, policies, or restrictions
● Unavailability or disruption of building facilities, amenities, or shared areas (such as
swimming pools, gyms, parking, elevators, or reception services)
● Noise, disturbance, maintenance, renovation, or construction activities originating from
neighbouring units, nearby properties, or external surroundings
● Temporary utility disruptions or service interruptions caused by third-party providers or
building management

While ELARA Homes will make reasonable efforts to assist guests in such situations where possible, we do not have operational control over external building infrastructure, community facilities, or third-party activities.

Nothing in these Terms excludes or limits liability where such exclusion is not permitted under applicable law.

10. Force Majeure

We are not liable for failure to provide services due to events beyond our control, including but not limited to:

● Natural disasters
● Government actions
● Power failures
● Pandemics
● Transport disruptions

11. Intellectual Property

All website content, branding, images, and materials are owned by ELARA Homes unless otherwise stated.

You may not copy or reuse content without written permission.

12. Governing Law

These Terms are governed by the laws of the United Arab Emirates and applicable regulation in Dubai.

Any disputes shall be subject to the jurisdiction of Dubai court
