Guests are expected to treat the holiday home, its furnishings, fixtures, appliances, décor, and all other contents with reasonable care throughout their stay. The registered guest is responsible for the conduct of all occupants and visitors associated with the booking and for ensuring compliance with ELARA Homes’ Terms & Conditions and House Rules.
Personal Belongings
Guests are solely responsible for the safekeeping of their personal belongings, including but not limited to cash, jewellery, electronic devices, passports, travel documents, luggage, and other valuables. ELARA Homes shall not be liable for any loss, theft, damage, or disappearance of personal belongings during the stay, except where such liability cannot be excluded under applicable law. Guests are encouraged to secure all valuables and ensure that doors and windows are locked whenever the property is unattended.
Damage to the Property
Guests are responsible for any loss, damage, breakage, missing items, excessive cleaning, or misuse of the property caused by themselves, members of their party, or their visitors during the booking period, excluding reasonable wear and tear.
Where damage or loss is identified after check-out, ELARA Homes reserves the right to recover the reasonable costs of repair, replacement, restoration, or additional cleaning.
Security Deposit
Where a security deposit has been collected, ELARA Homes reserves the right to deduct all or part of the deposit to cover:
● Damage to the property or its contents.
● Missing furniture, furnishings, appliances, keys, access cards, remote controls, linens,
towels, kitchenware, or other items.
● Excessive cleaning required beyond normal use.
● Unauthorised smoking, pets, parties, or events where prohibited.
● Additional charges arising from breaches of these Terms & Conditions or House Rules.
If the total cost of repairs, replacements, or losses exceeds the amount of the security deposit, the guest agrees to reimburse ELARA Homes for the outstanding balance upon request.
Where no damage, loss, or additional charges are identified following inspection of the property, the security deposit will be refunded in accordance with ELARA Homes’ Security Deposit Policy.
Right to Recover Costs
ELARA Homes reserves the right to seek reimbursement for any financial loss, damage, legal costs, regulatory fines, or other expenses arising from a guest’s breach of these Terms & Conditions, including costs that exceed the security deposit.
Limitation of Liability
To the maximum extent permitted by applicable law, ELARA Homes shall not be liable for indirect, incidental, consequential, or special damages arising from a guest’s stay, including the loss of personal belongings, except where such liability results from ELARA Homes’ negligence or cannot legally be excluded.
